Potential for botulism could lead to products liability claims

Many Georgia residents start their days with hot or cold coffee. The added kick that caffeine provides helps many people get going. Some people add cream and sugar to their coffee, and some even drink it cold, but they more than likely would not even think about adding a potentially deadly toxin to it. Unfortunately, one coffee drink, Death Wish Nitro Cold Brew, could come with a deadly toxin that may lead to products liability claims if someone ends up sick.

Death Wish Coffee Co. claims to sell the strongest coffee in the world. It may be the way the coffee is processed, which lead to the formation of botulin toxin. Once the potentially deadly problem was discovered, the coffee company issued a recall of its 11-ounce cans of Death Wish Nitro Cold Brew. Anyone in Georgia who drinks this brew should stop doing so immediately. The company has already pulled the product from its website and has instructed retailers to do the same, and production of the product was also shut down in order to correct the manufacturing issue that led to this recall.

Botulism can cause a variety of symptoms such as abdominal distension, weakness and dizziness. People could also experience double vision, have difficulty breathing or become constipated. This form of food poisoning can be deadly, so anyone experiencing these symptoms should get to a doctor immediately.

So far, the company has not received any reports of illness, but that does not mean it cannot happen. Those who become seriously ill or lose a loved one to botulism may exercise their rights to file products liability claims against the responsible party or parties. Product manufacturers, distributors and suppliers owe a duty of care to produce safe products. When that does not happen, and people suffer harm as a result, they may be held financially responsible for it.
