Could Fitbit face a products liability suit?

Many Georgia residents now track their daily step counts, heart rates and other important health factors through wearable technology. Of the options on the market, Fitbit is one of the most popular health watches. Now, it could soon be the subject of a products liability claim.

Fitbit advertises its Charge HR model as a device that continuously and accurately tracks a wearer's heartbeat. This is supposed to indicate a person's exercise intensity, which can provide guidance on their activity levels. Are they pushing too hard? Can they work harder? 

Not so, says one consumer. She discovered that her Fitbit routinely registered her heart rate much lower than a more reliable chest-mounted monitor. Other consumers had the same results. Many other users also complained that their Fitbits registered their heart rates incorrectly, either too low or too high, and were off by as many as 30 beats per minutes. An expert with a doctorate for exercise science says that this is dangerous since consumers rely on those readouts to be accurate, and cautioned that the company should change how it markets the watches until the technology is fixed.

Some consumers are now worried that they were misled into purchasing defective products. After all, Fitbit advertised their Charge HR and other models as accurate heart rate trackers. What consumers received was something that regularly provides inaccurate information.

Products liability claims are essential tools for Georgia consumers who have been harmed by companies. While they often provide necessary compensation when successfully pursued to completion, there is another added benefit. Companies that are held responsible for their actions may be more likely to avoid such behavior in the future, which can protect fellow consumers from experiencing similar trauma.
